1. Property Listing

1.1Submission

You agree to provide accurate and up-to-date information while submitting property listings. You are solely responsible for the content you submit, including property details, images, and other materials. Ensure that you have all necessary rights and permissions to use and publish the content.

You agree not to use the Service for any illegal, fraudulent, or abusive purposes, or to submit content that is misleading, defamatory, or violates any third-party rights.

We reserves the right to review, edit, or reject any submitted property listing at its sole discretion, without providing reasons for such actions.

1.2Representative Images

Property owners must ensure that all submitted listings contain accurate and representative images of the property. For existing properties, owners are prohibited from using misleading images, such as artist's impressions or solely photos of amenities and surroundings. The photos provided must truthfully represent the actual condition of the property.

For new or under-construction properties, showroom photos are allowed.

1.3Disclaimer Regarding Authenticity of Ownership

While REALE takes significant measures to verify the authenticity of property listings, we cannot guarantee that all documents submitted for verification are genuine or free from fraud. Users acknowledge that REALE relies on the documentation provided by property owners, and despite our best efforts, fraudulent information may occasionally be submitted. You further acknowledge and understand that there remains a possibility of deceptive practices by certain individuals, such as listing properties they do not own.

REALE disclaims any liability for any loss or damage incurred by users as a result of false, misleading, or fraudulent documents or listings. Buyers are encouraged to conduct their own due diligence in addition to the verification process provided by REALE.

1.4Limitation of Liability

REALE does not endorse or guarantee the accuracy, completeness, or quality of any property listing or content submitted by users.

1.5Use of Information

By posting your listing(s) on the Website, you agree to allow us to use this data for reporting and summary purposes. The information may be included in our Insights page, which is a summary of our database for users' reference.

We take your privacy and the confidentiality of your personal information seriously. We assure you that no personal information associated with the property listings will be disclosed in our Insights page. Only aggregated and anonymized data will be presented for statistical and informational purposes.

1.6Eligibility

You must be a registered member to post a listing on REALE.

2. Redigitize

2.1Disclaimer

While we endeavor to achieve accuracy, we cannot guarantee that the converted 2D floor plan will precisely match your original sketch or fulfill all your specific requirements.

We disclaim liability for any errors or omissions in the converted floor plan resulting from unclear or inaccurate sketches or missing information.

We shall not be held accountable for any damages or losses arising from or in connection with your use of the Redigitize service, including but not limited to direct, indirect, incidental, consequential, special, or punitive damages.

3. SwiftAssist

3.1Disclaimer

While REALE diligently selects trustworthy representatives, it cannot assume liability for any damages or losses incurred to the property during the period in which spare keys are in the representatives' possession. Property owner will need to agree not to hold REALE or its representatives responsible for any damages or losses claimed.

Furthermore, REALE and its representatives shall not be held responsible for any damages or losses arising out of or in connection with your use of the service. This includes, but is not limited to, direct, indirect, incidental, consequential, special, or punitive damages. Such damages may arise from various factors, including the actions of our representatives, property damage, or disruptions to your property viewing schedule.

3.2Responsibility to Finalise Deal Remains to the Owner

It is not within the scope of the representatives' duties to finalize deals on behalf of the property owner during property viewings. The responsibility for follow-up actions and the endeavour to close the deal for the property sale solely rests with the property owner. Consequently, REALE and its representatives cannot be held liable for any damages or losses resulting from the failure of a property sale transaction.

4. Zoom-In

4.1Information and Updates

Zoom-In strives to offer accurate and up-to-date information on selected mega-structures in Malaysia. However, we cannot guarantee the absolute accuracy or completeness of this information. We reserve the right to update, modify, or remove information at any time without prior notice.

4.2Disclaimer and Limitation of Liability

We make no warranties, express or implied, about the information provided in zoom-in. we are not responsible for any damages or losses arising out of or in connection with your use of zoom-in, including direct, indirect, incidental, consequential, special, or punitive damages.

GENERATIVE AI

5. REALE Assistant

5.1Disclaimer and Limitation of Liability

REALE Assistant is an AI-powered tool designed to assist users with information related to the Malaysian property market. While we aim to provide accurate and up-to-date information, we cannot guarantee the complete accuracy, reliability, or comprehensiveness of the data and insights provided. The information presented may change, and we reserve the right to update, modify, or remove content without prior notice.

Please note that REALE Assistant is currently in beta. This means the system is still undergoing testing and refinement, and there may be inaccuracies or limitations in its performance. While we are committed to regularly updating our database to ensure relevant and current information, users are strongly advised to independently verify any critical details before making decisions. REALE Assistant should be considered a supplementary tool and not a definitive source for decision-making in property matters.

Additionally, despite using correct and verified datasets, there is a possibility that the AI Assistant may provide incorrect or misleading information due to the inherent limitations of AI technology. By using REALE Assistant, you acknowledge and accept these terms, including the potential for errors and the need for independent verification.

FUNCTIONS / TOOLS

6. Search Function

The Website provides a search and filtering function that allows users to search for properties based on various criteria, such as property type, price range, and location. The data collected from these searches is used for insight-generating purposes in our Insights section.

6.1Data Collection

We collect and store data related to property searches conducted on the Website. This data includes information such as property type, search criteria, and search frequency. Please be assured that this data does NOT include any personally identifiable information.

6.2Data Anonymity

We ensure that all search data collected is anonymous and does not include personally identifiable information. No user's identity will be associated with their search data in our analytical reports or insights.

7. Messaging Function

7.1Messaging Function Usage

The messaging function provided by REALE enables members to communicate between property owners and potential buyers. It is intended for legitimate and lawful purposes related to property listings. REALE encourages users to utilize the messaging function for communication, as it provides a layer of privacy by not revealing personal contact details. However, members have the freedom to voluntarily disclose their personal contact information in their listings or through messages.

7.2Eligibility

You must be a registered member to use the messaging function on REALE.

8. Messaging Function - Prohibited Activities

8.1Marketing or Promotion of Products and Services

As our messaging function is intended solely for the purpose of facilitating communication between our property owners and potential buyers. We strictly prohibit the use of this function for any form of marketing, promotion of products or services, or solicitation. Real estate agents and negotiators are also not allowed to contact property owners through this platform for leads or business purposes.

8.2Other Activities

• Sending unsolicited commercial messages (spam) or any form of unauthorized advertising.
• Harassing, threatening, or abusing other users or any individuals through the messaging function.
• Impersonating any person or entity or falsely representing your affiliation with any person or entity.
• Sending or transmitting any content that is unlawful, defamatory, obscene, or violates any third-party rights.
• Attempting to gain unauthorized access to other members' accounts or to any part of the messaging function system.

8.3Consequences of Violation

REALE is intended for responsible users only. Engaging in any of the prohibited activities mentioned above is strictly prohibited and will result in immediate account blocking. A blocked member will lose access to certain services and features of the Website, such as the messaging function and listing a property. Additionally, a blocked member is not eligible for refunds, if he or she is a REALE Member.

If you believe your account has been wrongly blocked, you may contact our support team at support@reale.com.my to appeal the decision.

Please note that we take these rules seriously to maintain the quality of our platform and protect the privacy and interests of our users. We reserve the right to enforce these consequences as we deem necessary.

9. DSR Calculator / Fees Calculator / Loan Calculator

9.1Disclaimer and Limitation of Liability

The DSR calculator, fees calculator, and loan calculator ("calculators") provided on the Website is intended to offer users an estimate of DSR, fees incurred, and monthly loan payments respectively based on the entered information. Please note that the results are for reference purposes only and should be treated as general estimates.

The results generated by the calculators are based on the information provided by the user and certain assumptions. Actual loan terms, interest rates, fees, costs, and other factors may vary and can only be determined by the banks or solicitors. Users are advised to consult directly with qualified professionals for more accurate information.

ACCOUNT

10. Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

11. Account Deletion

11.1User-Initiated Deletion

Users have the right to delete their account at any time. This action is irreversible and will permanently remove all associated data from our systems.

11.2Data Removal

Upon account deletion, all information related to the user will be permanently erased, including but not limited to:

• All chats created between buyers and sellers.
• All favorite listings saved.
• All property listings created by the user.

12. Prohibition of Data Scraping and Automated Access

12.1No Data Scraping

You agree not to use, nor permit any third party to use, any form of automated tool, bot, scraper, crawler, spider, or other methods (whether manual or automated) to access, extract, or collect data, content, or any other information from the Website without the express prior written consent of REALE. This prohibition includes, but is not limited to, accessing the Website for data scraping, data mining, data harvesting, or any similar activities intended to extract information for any unauthorized purpose, including but not limited to commercial, research, or personal use.

12.2Blocking and Monitoring

REALE reserves the right to monitor access to the Website and take appropriate actions to block, suspend, or terminate access by any user or entity that engages in scraping or similar activities. This may include implementing technological measures such as CAPTCHA systems, IP blocking, or other automated mechanisms to detect and prevent such behavior.
